2. Applicability & Key UK Consumer Rights
These Terms apply to all orders placed via perfect-dreams.co.uk. Nothing in these Terms affects your statutory rights under UK law, including the Consumer Rights Act 2015 and (for most online purchases) the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“CCR 2013”).
Summary of key rights:
Goods must be as described, of satisfactory quality, and fit for purpose.
You may have a short‑term right to reject faulty goods within 30 days of delivery; after that, a right to repair or replacement.
For most online purchases (see exclusions in §9), you have a 14‑day cancellation period from delivery to change your mind, followed by 14 days to return items.
3. Eligibility & Your Account
You must be at least 18 to place an order.
You are responsible for keeping your account details and passwords confidential and for all activities under your account.
Information you provide must be accurate and complete.
4. Products, Descriptions & Availability
We sell beds, mattresses, and bedroom furniture. Images are for illustrative purposes; product colours and finishes may vary due to screen settings or natural materials.
Dimensions are approximate; please allow typical tolerances. Always check room access (stairs, lifts, doorways).
We may discontinue or substitute products. If an item is unavailable after you order, we will notify you and offer a refund or alternative.
5. Pricing, VAT & Errors
Prices are shown in GBP (£) and include UK VAT where applicable.
Delivery and service fees (e.g., assembly, room‑of‑choice, old‑item removal) are shown at checkout.
We may correct pricing or description errors. If an error materially affects your order, we will contact you to confirm the order at the correct price or cancel with a full refund.
6. Payment & Fraud Prevention
We accept major credit/debit cards and selected third‑party payment providers (e.g., PayPal / finance providers where offered).
Payment is taken when you place the order (or per the terms of your chosen payment provider).
Orders are subject to security checks. We may decline or cancel an order if we suspect fraud or unauthorised activity.
7. Delivery & Access
Standard delivery is to UK mainland addresses (exclusions/surcharges may apply for remote locations). Estimated delivery windows are shown at checkout and are indicative, not guaranteed.
Access: You must ensure safe and adequate access to the property and room of delivery (clear hallways/stairwells; parking/permits arranged). We are not responsible for removal of doors, windows, or fixtures unless specifically agreed.
Room of choice / Assembly: If purchased, our team will deliver to the selected room and/or assemble items as specified.
Failed delivery: If we cannot complete delivery due to access, unsafe conditions, or no one present, a re‑delivery/return fee may apply.
Risk & title: Risk in goods passes on delivery. Ownership passes once we receive full payment.
8. Inspection on Delivery
Please inspect items upon delivery and report any visible damage on the delivery note and to us within 48 hours (with photos). This does not affect your statutory rights for latent defects discovered later.
9. Cancellations & Returns (Change of Mind)
9.1 Your right to cancel (CCR 2013)
For most online purchases you may cancel within 14 days of delivery without giving a reason. You then have 14 days to return the goods.
9.2 Exclusions (for hygiene and custom goods)
The right to cancel does not apply to:
Mattresses, toppers, pillows, and protectors once unsealed/opened after delivery for health & hygiene reasons.
Made‑to‑order, personalised, or bespoke items (e.g., non‑standard sizes, custom fabrics).
Goods that have been used, assembled, or are not in a resellable condition.
9.3 How to cancel
Email us at perfect-dreams@hotmail.co.uk within the 14‑day period.
Please provide: order number, item(s), delivery date, and your contact details.
9.4 Returning items
Return items unused, in original packaging, and securely packaged.
You are responsible for return shipping costs, except where goods are faulty or misdescribed.
We may deduct for diminished value resulting from unnecessary handling beyond what is needed to inspect the goods.
9.5 Refunds
We will refund the product price and the standard outbound delivery cost (if any) within 14 days of receiving the goods back or proof of return, using your original payment method.
Upgraded services (express delivery, room‑of‑choice, assembly, old‑item removal) are non‑refundable once performed.
10. Faulty or Misdescribed Goods
If a product is faulty or not as described, contact us promptly with details and photos.
Within 30 days of delivery, you may have the right to reject the goods for a full refund. After 30 days, we may repair or replace; if that is impossible or fails, you may be entitled to a price reduction or final right to reject per the Consumer Rights Act 2015.
We will bear reasonable return or collection costs for confirmed faulty goods.
11. Assembly, Old‑Item Removal & Recycling Services
If purchased, assembly will follow manufacturer instructions. We cannot modify products or your property.
Old‑item removal/recycling (where offered) requires items to be clean, de‑infested, and bagged (e.g., mattresses in a protective bag) and ready at the door at the arranged time.
We reserve the right to refuse removal for health/safety reasons or if items are water‑damaged, soiled, or structurally unsafe.
12. Mattress Trials & Comfort Guarantees
Unless expressly stated on a product page or your order confirmation, we do not offer a mattress trial or comfort guarantee beyond your statutory rights. Any trial offered will have specific conditions (e.g., mandatory protector use, minimum trial period, exchange rules).
13. Promotions, Vouchers & Gift Cards
Promotional codes and offers are subject to individual terms, may not be combined, and may be withdrawn at any time.
Gift cards/vouchers are non‑refundable and not redeemable for cash, except where required by law.
14. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under law.
Subject to the above, we are not liable for:
losses not caused by our breach;
business or indirect losses (loss of profit, revenue, data, or goodwill);
delays or failures due to events outside our reasonable control (see §15).
Except where prohibited by law, our total liability for any order is limited to the amount you paid for that order.
15. Events Outside Our Control
We are not responsible for failure to perform or delays caused by events beyond our reasonable control (e.g., extreme weather, transport disruptions, strikes, epidemics, supplier failures). We will inform you as soon as reasonably possible and take steps to minimise the effect.
16. Website Use & Intellectual Property
Content on our website is owned by or licensed to us and is protected by intellectual property laws.
You may use the site to browse and purchase products; any other use (including scraping, copying product images/descriptions, or framing) is prohibited without our written consent.
17. Privacy & Data Protection
Your privacy matters. Please see our Privacy Policy and Cookie Policy for details on how we process personal data, cookies, and your rights. By placing an order, you acknowledge our data practices as set out in those policies.
18. Complaints & Dispute Resolution
We aim to resolve issues quickly. Please contact us via perfect-dreams@hotmail.co.uk with your order number and details.
If we cannot resolve a dispute, you may be able to use Alternative Dispute Resolution (ADR) (e.g., RetailADR or The Furniture & Home Improvement Ombudsman) if we are a member of such schemes. Otherwise, your matter may be brought before the courts (see §19).
19. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. You may bring legal proceedings in the UK courts where you live.
20. Model Cancellation Form (CCR 2013)
(Complete and return this form only if you wish to cancel the contract under your 14‑day right to cancel for distance sales.)
